Making a passenger accident injury claim in Brisbane and Queensland

Unlucky understand passengers involved in any vehicle accident are at equal risk of being injured. If you’ve been injured as a passenger in a car or on a motorbike, then we might be able to help you to claim compensation. We have a wealth of experience in claiming compensation for people who’ve sustained serious road accident injuries. They can have grave, long-lasting effects on your life. Suffering an injury can be expensive, as you may need to take time off work or pay for medical treatment. Expenses can mount as income decreases, increasing stress and worry. Claiming compensation makes it easier for you to get back to your daily life as quickly as possible, by providing financial support through an uncertain time.

We can also help you to claim on a no win no pay basis. This means that if for some reason your case is not successful, you are not liable to pay out of pocket. A ‘no win, no fee’ claim may not be available, but your lawyer will let you know before you proceed.

  1. The first step to making a passenger accident claim is to contact us. Our legally trained advisors deal with cases like yours every day. They’ll talk about what happened before transferring you to a solicitor to determine whether or not you have a claim. Please rest assured there’s no obligation to proceed.
  2. Your lawyer will talk you through the claims process and answer all the questions you may have.
  3. Your lawyer will then make contact with the other party and negotiate on your behalf, leaving you with the time to focus on other things. They can keep you informed of the case as it progresses.

What if the driver has no Qld insurance policy?

All drivers are required to have compulsory third party (CTP) insurance to cover the cost of compensation claims or damages to other road users. In rare

cases, drivers do not register their car or pay CTP insurance.

So, if the driver who was at fault for your accident does not have insurance, you are still able to make a claim, as in these circumstances your compensation will be paid by your state’s transport accident commission.

Accidents caused by adverse road conditions

If your passenger accident was the result of poor road conditions such as potholes or cracks in the road, we make a claim against the state road agency or your local council.

Roads must be properly maintained for road user safety. If you’ve been injured as a passenger in a road accident caused by unacceptable road conditions, then it’s not your fault. If so, you may be entitled to compensation for your injury.

It’s important to remember that making a claim will show the governing body that their road is not up to standard. This may prevent others from suffering the same injury.

Claiming against a friend or family member

If a vehicle driven by a friend or family member caused your injury, we completely understand that you may feel uncomfortable or embarrassed about making a claim.

You may be worried that your compensation will make them pay for it out of their own pocket, and possibly ruin your relationship with them.

To allay your fears, their insurance company will be on the hook for compensation, not your friend or loved one. It won’t leave them with the bill, but it will improve your life.

Car accidents can often happen because the driver was under the influence of drugs or alcohol. The legal blood alcohol concentration (BAC) is 0.5, or 0.0 for provisional/probationary drivers.

If your friend or family member was over the limit and you were aware of this, this can affect your claim. If you didn’t know they were intoxicated, then this will have no effect on your compensation.

Accidents on public transport

You may have been injured while travelling on public transport, for example, as a passenger on a bus, tram, train, or in a taxi/Uber.

Public transport drivers have a duty of care to you and an obligation to drive

safely and responsibly. If they’ve failed in their duty and you sustained an injury due to this, then you may be able to make a compensation claim.

Below are some common causes of public transport passenger injuries:

  • The bus or taxi you were a passenger on collided with another vehicle
  • The bus driver pulled away while you were exiting the vehicle, causing you to fall
  • Careless driving caused you to bump your head on the seat in front of you, fall off your seat or fall over on a bus

Many different injuries happen on public transport, and you could make a claim for them. To find out, contact us on 1800 106 107. Our advisors will talk with you about what happened and let you know your eligibility over the phone. Your call with us is free, confidential and there is no obligation to claim.

Serious injuries

Unfortunately, road accidents often result in serious or even life-changing injuries for passengers. If your injury caused chronic pain, an interruption to your daily routines, we understand how traumatic and upsetting it is.

We know that no amount of compensation can relieve the pain and suffering that you may have experienced. But claiming compensation can help to alleviate the drain on your finances so that you can concentrate on your recovery.

When you feel ready to talk about what happened, you can call our friendly advisors on 1800 106 107 for confidential, free information on how we can make a claim together
